These Terms of Service (“Terms”) are a legal agreement between you and Apex Property Management (“Apex,” “we,” “us,” or “our”) governing your access to and use of our website located at apexindy.com (the “Site”), including browsing property listings, submitting rental applications, and making payments. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you should not use the Site.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Site to submit a rental application or make a payment. By using the Site for these purposes, you represent that you meet these requirements.
2. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Provide false, misleading, or fraudulent information in any form, application, or payment;
- Interfere with or disrupt the operation of the Site or the servers or networks used to make it available;
- Attempt to gain unauthorized access to any portion of the Site, other users’ accounts, or our systems;
- Use any automated means (bots, scrapers, crawlers) to access, copy, or monitor the Site without our prior written consent; or
- Copy, reproduce, republish, or create derivative works from the Site’s content without our permission.
3. Property Listings
We make reasonable efforts to keep property listings, including availability, pricing, and photographs, accurate and current. However, rental availability can change quickly, and we do not guarantee that any listing on the Site reflects real-time availability. Listings are provided for general informational purposes and do not constitute a binding offer to lease. A tenancy is only established upon execution of a written lease agreement.
4. Rental Applications and Tenant Screening
Submitting a rental application through the Site does not guarantee approval, and does not create a lease or tenancy. All applications are subject to our standard screening criteria, which may include verification of identity, income, employment, rental history, and a background and/or credit check performed by us or by a third-party screening provider, in accordance with the Fair Credit Reporting Act and applicable law. By submitting an application, you authorize us and our screening providers to obtain and use this information to evaluate your application.
5. Fair Housing
Apex Property Management is an Equal Housing Opportunity provider. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by federal, state, or local law.
6. Fees and Payments
Certain actions on the Site, such as submitting a rental application, may require payment of a fee. All online payments are processed securely by Stripe, Inc., our third-party payment processor, and are subject to Stripe’s own terms and privacy practices. By submitting payment, you represent that you are authorized to use the payment method provided. Except as required by applicable law, application fees and other processing fees are non-refundable once submitted, including where an application is not approved.
7. Third-Party Services and Links
The Site may link to, integrate with, or rely on third-party services, including our online tenant portal, our payment processor, and tenant screening providers. We do not control and are not responsible for the content, availability, or practices of these third parties. Your use of any third-party service is governed by that provider’s own terms and policies.
8. Intellectual Property
The Site and all content on it — including text, graphics, logos, photographs, and software — are owned by Apex Property Management or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may view and print pages from the Site for your own personal, non-commercial use related to evaluating a rental with us. Except as expressly permitted, you may not copy, modify, distribute, sell, or otherwise exploit any content from the Site without our prior written consent.
9. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, APEX PROPERTY MANAGEMENT AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS LIMITS ANY RIGHTS OR PROTECTIONS YOU HAVE UNDER APPLICABLE LANDLORD-TENANT LAW THAT CANNOT BE WAIVED BY AGREEMENT.
11. Indemnification
You agree to indemnify, defend, and hold harmless Apex Property Management and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your violation of these Terms or your misuse of the Site.
12. Termination of Access
We may suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable, without limiting any other remedies available to us.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Marion County, Indiana, and you consent to personal jurisdiction in those courts.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
15. No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
16. Entire Agreement
These Terms, together with our Privacy Policy and any lease or application documents you sign with us, constitute the entire agreement between you and Apex Property Management regarding your use of the Site, and supersede any prior agreements regarding the same subject matter.
17. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
