Apex Property Management (“Apex,” “Company,” “we,” “us,” or “our”) respects your privacy and is committed to handling your personal information responsibly. This Privacy Policy explains what information we collect through our website located at apexindy.com (the “Site”), how we use and share that information, and the choices available to you. By using the Site, submitting a form, applying for a rental, or making a payment through the Site, you acknowledge that you have read and understood this Privacy Policy.
1. Information We Collect
1.1 Information You Provide to Us
We collect personal information that you voluntarily provide when you interact with the Site, including:
- Contact information: name, email address, phone number, and mailing address, when you submit a contact form or otherwise reach out to us.
- Rental application information: name, date of birth, current and prior addresses, employment and income information, proof of income (such as pay stubs), vehicle information, emergency contacts, references, and any other information requested on our rental application.
- Payment information: when you pay an application fee or other charge through the Site, your payment is processed by Stripe, Inc., our third-party payment processor. We do not collect or store your full credit or debit card number, and we never see or retain your card’s security code.
- Correspondence: the content of messages, emails, or other communications you send us.
1.2 Information We Collect Automatically
When you visit the Site, we and our service providers automatically collect certain information about your visit, including your IP address, browser type and version, device type, operating system, pages viewed, referring/exit pages, and the dates and times of your visits. We use Google Analytics for this purpose, which relies on cookies and similar technologies. See Section 4 (Cookies and Analytics) below for more detail.
1.3 Information We Obtain from Third Parties
If you submit a rental application, we may obtain additional information about you from third-party tenant screening providers, including credit reports, criminal background information, eviction history, and rental history, in accordance with the Fair Credit Reporting Act and applicable state law. We only request this information with your authorization, which is typically obtained as part of the application process.
2. How We Use Your Information
We use the personal information we collect to:
- Evaluate and process rental applications, including screening applicants for creditworthiness, rental history, and eligibility;
- Communicate with you about inquiries, applications, leases, and account or tenancy matters;
- Process application fees and other payments;
- Operate, maintain, secure, and improve the Site;
- Understand how visitors use the Site through aggregated analytics;
- Comply with applicable laws, regulations, legal process, or governmental requests; and
- Protect the rights, property, and safety of Apex, our tenants, applicants, and others.
We do not use your information for automated decision-making that produces legal or similarly significant effects without human review, and we do not use your information to send unsolicited marketing communications unless you have separately agreed to receive them.
3. How We Share Your Information
We do not sell your personal information. We may share information with:
- Service providers who perform services on our behalf, such as Stripe (payment processing), tenant screening and background/credit check companies, our property management software provider (currently Rent Manager), our website hosting provider, and Google Analytics;
- Legal and safety purposes, including in response to a subpoena, court order, or other legal process, or where we believe disclosure is necessary to protect the rights, property, or safety of Apex, our tenants, or others; and
- A successor entity, in the event of a merger, acquisition, reorganization, or sale of some or all of our assets, subject to standard confidentiality arrangements.
Each of these service providers is authorized to use your information only as necessary to provide services to us and is contractually or otherwise required to protect your information.
4. Cookies and Analytics
Our Site uses cookies and similar tracking technologies to support core site functionality (such as form submission and fraud prevention on our payment processor) and to understand how visitors use the Site through Google Analytics. Google Analytics uses cookies to collect standard internet log and visitor behavior information in an anonymous form. You can control or delete cookies through your browser settings, and you can opt out of Google Analytics tracking generally by installing the Google Analytics Opt-out Browser Add-on, available at tools.google.com/dlpage/gaoptout. Disabling cookies may affect the functionality of certain parts of the Site.
5. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to maintain business records, comply with our legal and tax obligations, resolve disputes, and enforce our agreements. Rental application materials are generally retained for a limited period after a leasing decision is made, consistent with applicable fair housing and recordkeeping requirements, after which they are securely deleted or de-identified.
6. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect, including transmitting data over encrypted (HTTPS) connections and relying on a PCI-compliant third-party payment processor for handling card payments. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee the absolute security of your information.
7. Your Choices and Rights
You may contact us at any time to:
- Ask what personal information we hold about you;
- Request that we correct inaccurate information; or
- Request deletion of information that we are not otherwise required to retain by law or legitimate business need.
Depending on where you live, you may have additional rights under state privacy laws (for example, certain rights available to California, Colorado, Connecticut, Virginia, or other state residents). If you would like to exercise any rights available to you, please contact us using the information in Section 11 below, and we will respond consistent with applicable law.
8. Children’s Privacy
The Site is not directed to children under the age of 18, and we do not knowingly collect personal information from children. If we learn that we have inadvertently collected personal information from a child, we will take reasonable steps to delete it.
9. Third-Party Links
The Site may contain links to third-party websites or services, including our online tenant portal and payment processor. We are not responsible for the privacy practices of these third parties, and we encourage you to review their privacy policies before providing them with information.
